On The Map Travel Terms and Conditions
We have been working in travel for a long time and know first-hand the rich rewards travel offers. We also know that things can go wrong and often those circumstances are beyond anyone’s control. While we make every effort to curate and manage your travels, it is important for you to know the limits to our control and responsibility. Please read the following carefully. Your signature on our How We Work document or by making a payment to On The Map Travel acknowledges your acceptance of these Terms and Conditions.
TRAVEL DOCUMENT REQUIREMENTS: The Transportation Security Administration requires all passengers to provide their name, date of birth and gender when making all airline reservations. For international travel, US citizens require a passport valid for at least 6 months beyond your return flight date. Non-US citizens should contact the appropriate consulate for information on all necessary documents. It is your sole responsibility to secure and/or pay for any and all visas, reciprocity fees, affidavits, immunizations, and any other requirements to be permitted entry into each destination. Your failure to have proper visas and/or passport will likely result in you not being able to leave a country or enter a destination and no refund will be available in any such case and On The Map Travel, LLC will have no liability in such case.
Due to the COVID-19 pandemic, some destinations may have specific requirements including but not limited to proof of a negative COVID-19 test, a full set of vaccinations and health insurance. It is your sole responsibility to understand the requirements specific to your travel destination(s) and comply with those requirements. Please note that it is possible for requirements to change while you are traveling. While On The Map Travel will monitor such requirements, we cannot be responsible for their enforcement, or any costs or delays imposed by those requirements.
Failure to have proper visas and/or a passport, or other required documents, will likely result in you not being able to leave a country or enter a destination. On The Map Travel cannot accept any liability in such a case.
Responsibility: On The Map Travel, LLC acts only as agent for the suppliers in regards to travel, whether by plane, car, motor coach, ship or railroad and assumes no liability for injury, damage, loss, accident, delay or irregularity which may be occasioned either by reason or defect of any vehicle, act of war, insurrection, health crisis, pandemic, revolt or other civil uprising, other military action, strikes or any Act of God occurring in either the country of origin, destination or through passage, or for any reason whatsoever, or through the acts or default of any company or persons engaged in arrangements of your travel. Any travel services arranged or described in any brochure, flyer, electronic communication letter or website, including without limitation transportation, lodging, and sightseeing, are provided by the carrier, hoteliers, and other suppliers that are independent contractors and not agents or employees, partners, or joint ventures of On The Map Travel, LLC. On The Map Travel, LLC distributes tickets, vouchers, and other travel documents for such services merely as a courtesy for the companies that furnish such services. Such tickets, vouchers, and other travel documents are subject to all terms and conditions of the respective suppliers (some of them may limit or exclude the supplier’s liability). They cannot accept any responsibility for losses or additional expenses due to delay or changes in air schedules or other causes. All such losses or expenses will be the responsibility of the traveler as the rates provided are for the arrangements only at the time stated. The right is reserved to make any adjustments to the services as required. On The Map Travel, LLC may not be held responsible for any loss or damage to luggage, before, during or after you travel. The traveler expressly waives all rights which he or she may have against On The Map Travel in connection with the foregoing. Under no circumstances is the On The Map Travel, LLC be construed as a carrier under contract for safe carriage of the passenger or his or her baggage and belongings.
CANCELLATIONS: In the event we book and confirm any services for your trip, and you cancel for any reason, we will charge you a cancellation fee of up to 20% of the cost of the services that were confirmed plus any out-of-pocket costs (i.e. document shipping, copying, long-distance calls etc.) directly associated with your booking.
In addition, you may incur cancellation fees from other service providers (including, but not limited to, airline tickets, hotels, tours, transfers, train tickets and car rentals). These fees vary by provider and service booked.
CURRENCY EXCHANGE RATES: Exchange rates with the US dollar are subject to change. When possible, we will quote your program price in the currency of your destination. Payments to On The Map Travel, however, need to be made in USD. This amount due will be based on currency exchange rates as of the date of the invoice (s) and is subject to adjustment; the final exchange rate is determined when your credit card is processed and not by On The Map Travel.
SUPPLIER AGREEMENTS: On The Map Travel does not own, manage, control, run or operate any transportation or recreational vehicle (including any motor coach, boat, helicopter and/or airplane), hotel, restaurant, or any other supplier of services connected with a Trip. All tour services are subject to the terms and conditions specified by the supplier of such service and to the laws of the countries in which the services are supplied. The passage contract (Conditions of Carriage), when issued by the airlines concerned, shall constitute the sole contract between such airlines and you.
FORCE MAJEURE: Very rarely, you may be required by “force majeure” to change or terminate your trip after departure but before the scheduled end of your trip. This is unlikely but if this situation does occur, we will be unable to make any refunds (unless we obtain any refunds from our Suppliers), pay you any compensation, or meet any costs or expenses you incur as a result. On The Map Travel, LLC reserves the right to cancel any services described in a trip itinerary due to Force Majeure. On The Map Travel, LLC shall not be responsible for failure to perform any of its obligations under this Agreement during any period in which such performance is prevented or delayed due to Force Majeure, nor for changes to or terminations of your trip due to Force Majeure. Force Majeure refers to any event beyond On The Map Travel, LLC’s reasonable control, including but not limited to severe weather, fire, flood, mudslides, earthquakes, war, labor disputes, strikes, epidemics, World Health Organization’s advisories and/or alerts, disease, pandemic, virus, illness, Center for Disease Control’s advisories and/or alerts, U.S. State Department’s advisories and/or alerts, any order of any local, provincial or federal government authority, interruption of power Services, terrorism or any other causes beyond the control of On The Map Travel, LLC. No refund(s) will be issued for cancellations due to actual or threatened terrorist events. If travel plans are delayed or cancelled for any reason there will be no refunds issued by On The Map Travel, LLC, except in those that can be recovered from suppliers. Please note that services often consist of arrangements with multiple vendors and suppliers, including but not limited to airlines, hotels, transfers, sightseeing excursions, guide and hosting services, adventures, cruises, museum visits, wine tasting and dining experiences each of which may carry its own cancellation and refund policies penalties.
On The Map Travel, LLC, has made every effort to provide accurate information; and reserves the right to correct any errors or omissions in its published materials, documents all communications and to amend these Travel Terms and Conditions at any time as the result of any material changes to legislation or regulation. All amended Travel Terms and Conditions shall automatically be effective upon being posted by On The Map Travel to the website www.onthemaptravel.com. Accordingly, you should check the website prior to travel to access the most current Terms and Conditions.
CONTROLLING LAW AND JURISDICTION: If a dispute arises out of or relates to these Terms and Conditions, or breach thereof, you agree to contact On The Map Travel in writing and allow us to address the dispute and you agree not to initiate a chargeback process. If the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by the World Travel Dispute Center under the applicable guidelines as established by International Forum for Travel and Tourism (IFTTA) before resorting to arbitration, litigation, or some other dispute resolution procedure. If mediation is not successful, the parties will settle by binding arbitration administered by the World Travel Dispute Center under the applicable guidelines as established by IFTTA.
All parties hereby consent to the jurisdiction of all state and federal courts sitting in St. Louis County in the State of Missouri and agree that venue for any such action shall lie exclusively in such courts without regard to choice of law principles and agrees that such courts shall be the exclusive forum for any legal actions brought in connection with these Terms and Conditions.
In no event shall On The Map Travel, LLC be liable for other than compensatory damages, and you hereby waive all rights to punitive damages. You agree that you will only bring claims against On The Map Travel in your individual capacity and not as a plaintiff or class member in and purported class action or representative proceeding. You understand and agree that no claims will be considered and that you will not bring suit against On The Map Travel unless you have first provided written notice of claim to On The Map Travel.
You acknowledge and agree that we may change these Terms and Conditions from time to time and that those changes become effective immediately. If we make material changes, we will provide you notice. Your continued use of our services following the notice of any changes constitutes your acceptance and agreement to be bound by such changes. You agree to be bound by the Terms and Conditions that are in effect at the time of travel or cancellation.
In the event any provisions or covenants (or any portion thereof) of these Terms and Conditions shall be held invalid or unenforceable by any court of competent jurisdiction, such holding shall not invalidate or render unenforceable any other provisions hereof.
